Terms of Service

1. Description of Service

AI Workspace Pro is a software-as-a-service (SaaS) platform that uses artificial intelligence to generate websites, dashboards, calculators, trackers, and other web-based tools from plain-English descriptions. The Service is provided on a subscription basis.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. Account Registration

• You must provide a valid email address to create an account
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use at [email protected]
• One person may not maintain more than one free account

4. Subscription Plans and Billing

Free Tier

• Limited generations per month at no cost
• Subject to usage limits as posted on the Service

Usage Limits

• Paid subscriptions include a monthly generation allowance as described on the pricing page
• Additional generations may be purchased as top-ups
• Generation limits reset at the start of each billing period
• Unused generations do not carry over to the next period

All prices are in USD. MarketFoundry reserves the right to change pricing with 30 days notice to existing subscribers.

5. Refund and Cancellation Policy

All subscription fees are non-refundable except as required by applicable law. Specifically:

• If you cancel a monthly subscription, you retain access through the end of your current billing period. No partial-month refunds are issued
• If you cancel an annual subscription, you retain access through the end of your annual period. No partial-year refunds are issued
• If you experience a technical failure preventing use of the Service for an extended period due to our error, contact us at [email protected] and we will evaluate on a case-by-case basis

6. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, threatening, or abusive
• Create content that infringes on the intellectual property rights of others
• Generate malware, phishing pages, exploit code, or tools designed to harm others
• Produce content involving the sexual exploitation of minors
• Create content promoting violence, hate speech, or discrimination
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Circumvent usage limits, authentication, or access controls
• Resell or sublicense access to the Service without written permission
• Use the Service for any unlawful purpose

MarketFoundry reserves the right to suspend or terminate accounts that violate this section without refund.

7. AI-Generated Content

• The Service uses the Anthropic Claude API. Your prompts are transmitted to Anthropic for processing
• AI-generated content may contain errors, inaccuracies, or incomplete information
• You are responsible for reviewing and verifying all generated content before use
• MarketFoundry does not guarantee the accuracy, fitness for purpose, or legal compliance of generated content
• You own the output generated from your prompts, subject to Anthropic's usage policies and these Terms
• MarketFoundry retains the right to display anonymized examples of generated projects for promotional purposes unless you opt out

8. Intellectual Property

MarketFoundry IP

The Service, including its software, design, branding, and documentation, is owned by MarketFoundry LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

Your Content

You retain ownership of prompts you submit and the projects generated from them. By using the Service, you grant MarketFoundry a limited license to store, display, and process your content solely to provide the Service.

You agree to indemnify and hold harmless MarketFoundry LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

MarketFoundry may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Non-payment of subscription fees
• Conduct that we determine, in our sole discretion, is harmful to the Service or other users

You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Diego County, California.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
